Nick is accredited to accept instructions directly from the public. He undertakes all types of matters including contract, harassment, landlord & tenant, boundary disputes, neighbour disputes, building disputes, general civil litigation and motoring offences in the magistrates' courts.
Contractual Claims
Nick’s practice revolves around debt and contractual claims in the County Court and the High Court. His work involves fighting and defending claims at every level including, breach of contract, insolvency and bankruptcy, professional negligence, consumer credit, and landlord and tenant claims (commercial and residential) and possession and repossession. Nick also offers specific experience of claims arising out of gambling activity, including the unlawful witholding of winnings by online casinos.
Claimant: Nick's objective is to help you to recover as much money as you can. Nick is particularly well known for his never-say-die attitude – if he is instructed to fight your corner, that is exactly what he will do, using every tool at his disposal with the skill and passion he brings to his advocacy. Defendant: Where Nick is instructed by the defendant his role is to use his expertise to make sure you are protected and he will bring to your case every element of his expertise to ensure your defence is managed and presented in the best possible way.
Property, Landlord & Tenant and Housing Claims
Nick has a specialist interest in Landlord & Tenant disputes and Housing Disrepair claims and had built a strong reputation in this field. Nick gives seminars in this particular area of law and has dealt over 1000+ cases in this area of work. Nick will strive to reach the best possible outcome for the client from giving initial advice, drafting a claim or defence, attending interim hearings, full trials through to giving advice, drafting and attending appeals.
Nick accepts instructions to advise and represent clients in relation to a range or real property matters, including boundaries, easements, service charges, possession, repossession, adverse possession and rights of way, light and access. Nick has been praised for his technical knowledge and flexibility whilst giving straight forward and practical advice. As part of his wider property law practice, Nick accepts instructions to deal with Party Wall Act matters, up to and including enforcement.
Regulatory Crime & Motoring Offences
Nick has extensive experience of dealing with all manner of regulatory and motoring offences in the magistrates' court. His caseload in these areas includes prosecutions brought by local authorities for regulatory offences, speeding, drink-driving, drugs, anti social behaviour, driving without due care and failing to stop. He accepts instructions from clients to advise on how to plead in the face of charges and is very well-versed in the law and procedure in the magistrates' court. Nick can be instructed to attend court to represent clients at hearings from plea and mitigation, through to full contested trials. He offers very solid experience of running exceptional hardship arguments in cases where his clients' livelihoods depend on them retaining their driving licence in the face of potential disqualification.
Costs
Nick is a specialist in terms of costs hearings. Whether it is a Costs Case Management Conference or a detailed Costs hearing, Nick is always has a thorough knowledge of the issues and will fight hard to secure the best award for the client. Nick will ensure the maximum costs are recovered when acting for the winning party, or ensure that the minimum costs when those costs are payable. Nick will fight tooth and nail when it comes to the best interest of the client and instructing Solicitors.
Personal Injury and Clinical Negligence
Nick offers many years' experience of personal injury and clinical negligence claims, allocated to the fast and multi track. His experience of personal injury includes RTA claims, holiday sickness claims, Public and Employer's liability claims. From drafting an intial advice, particulars of claim, conferences with clients or experts through to the trial, Nick is keen to get involved at all stages of the process. Nick is happy travelling nationally for a conference either at a clients home address or instructing solicitors. Nick has specialst knowledge of these type of claims and is on several panels within Clerksroom.
Personal & Future Aspirations
When he’s not at work Nick is a volunteer on the Severn Valley Railway, which is a preserved heritage railway. Nick is very interested in, and devotes a lot of spare time in researching, the law relating to the railway industry. Disputes surrounding The Rule Book and related RAIB bulletins and investigations are of particular interest. If your work takes you to this specific area of law, Nick would very much like to come and talk to you.
At weekends Nick flies a PA28 aircraft and is a certified Flying Instructor. He enjoys taking people on their first ever flight as well as teaching Night Flying. Nick has night and instrument (R) rating.
Nick is accredited by the Professional Association of Diving Instructors as a Master Instructor, has completed in excess of 5000 dives all over the world, and has certified over 250 students. The law surrounding SCUBA diving is therefore also of great interest for Nick and he would love to expand his practice in this area.
Nick is also a member of the Magic Circle and regularly attends events and seminars nationally, as well as having a bee apiary in his back garden!
