Chambers UK Bar Guide [2017]
Mukhtiar is in a rare and enviable position of establishing his practice almost entirely through recommendations. He is frank with his clients and provides an early assessment of the merits of the case and the associated costs/risks.
He is able quickly to grasp the issues in a case and has successfully represented clients at hearings and trials despite “last minute” instructions.
Mukhtiar has offices in Central London and Kent. His main areas of practice are employment; civil litigation (particularly commercial, chancery and property); and professional discipline. He provides training and lectures solicitors on employment and contract law; and civil litigation.
Employment
Prior to becoming a barrister, Mukhtiar had 10 years’ experience in employment relations having acted for employees and employers. As such, he deals with all types of employment disputes for Claimants and employers in the Employment Tribunal, County Court and High Court:
Unfair dismissal and wrongful dismissal
Unpaid wages
Discipline, misconduct and performance
Long-term sickness absence
Compromise Agreements
Restrictive Covenants
Discrimination including disability discrimination
Whistleblowing
Working Time Regulations
National Minimum Wage
Maternity/adoption rights
Having an established civil practice means that he is regularly instructed for complex employment cases involving issues relating to civil remedies, partnerships, companies and negligence.
Civil litigation
A substantial part of Mukhtiar’s practice involves a broad spectrum of commercial law including contract disputes (particularly building and construction cases); fraud; banking; company and partnership law.
Mukhtiar has a substantial property practice covering a broad spectrum of disputes involving possession; breach of covenants (particularly landlord and tenant disrepair cases); boundary and party wall disputes; trespass, conversion and nuisance; enfranchisement; and service charges.
He deals with various complex disputes and has experience in IVAs and insolvency; trust disputes; will disputes; unincorporated associations; data protection; intellectual property; passing off; and defamation. Debt enforcement is another area of his expertise including charging orders and orders for sale.
Professional discipline
Mukhtiar applies his robust advocacy skills to his practical awareness. He has been advised on proceedings brought by the Nursing and Midwifery Council; Health and Care Professions Council; NHS (England); General Optical Council; and police. He is on the Royal College of Nursing panel.
